The BSG for SDG Microsite (referred to as ‘Microsite’) is provided by Bharat Soka Gakkai (‘BSG’) as part of its ‘BSG FOR SDG’ initiative to enable achieving the United Nations’ Sustainable Development Goals (‘SDGs’).

The terms and conditions listed out herein (“Terms of Use”) shall constitute a legally binding agreement between those who may choose to access this Microsite (‘you’) and BSG, concerning the use of this Microsite. 

By accessing this Microsite, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use. If you do not agree with any part of this Microsite or with these Terms of Use, your sole remedy is to discontinue using this Microsite. In addition, you shall also be subject to more specific restrictions that may be expressly applicable to specific parts of this Microsite.

1. ABOUT THE SITE:

This Microsite provides information and awareness about the SDGs and enables you to undertake certain activities and to offer your pledge to various SDGs.

2. NON-COMMERCIAL:

This Microsite is solely non-commercial in nature. Any commercial use of the whole or any part of the Microsite, including but not limited to any information/data on the Microsite, source code, is strictly prohibited.

3. YOUR OBLIGATIONS:

  • Conduct: You shall not misuse this Microsite (including without limitation, by hacking), and only use the Microsite for the proper non-commercial purpose for which it is made available by BSG, in compliance with all applicable laws, regulations, practice and otherwise in accordance with the other provisions of these Terms of Use.
  • Prohibitions: You undertake that you will not:
    • rent, lease, sell, sublicense, lend or in any manner allow any other party to use the Materials on the Microsite, with or without consideration.
    • recompile, disassemble, copy, modify, distribute, transmit, display, perform, reproduce, publish or create derivative works therefrom, transfer, or sell any information, software or tools accessed from this Microsite.
    • interfere with the operation or functionality of the Microsite in any manner whatsoever including but not limited to making available files containing corrupt data or viruses via whatever means;
    • deface, alter or interfere with the front end 'look and feel' of the Microsite or the underlying software code; or
    • take any action that imposes an unreasonable or disproportionately large load on the Microsite or related infrastructure.

4. USE:

  • View material uploaded by BSG on the Microsite.
  • Pledge to Campaigns posted by BSG.
  • Participate in the SDG Quiz posted in the SDG Quiz Section of the Microsite.

5. IPs ON THE MICROSITE

This Microsite is expressly owned and operated by BSG. Unless otherwise provided, intellectual property rights in materials in the Microsite, including and without limitation, PDFs, video, video graphics, footages, text, images, music, song, image design etc., are owned by BSG and are protected by Copyright unless expressly stated otherwise. The use of BSG Materials are provided on an ‘as is’ basis for your information, personal and non-commercial use only. Copying, reproduction, redistribution in any manner of the Microsite or any part thereof including but not limited to text content, video and graphics to any other server or location including caching of any kind is expressly prohibited. Any violation of the IP as referred to herein shall be governed by the applicable laws.

6. COPYRIGHT/TRADEMARK:

The copyright to this Microsite and the content of this Microsite, including, without limitation, all images, texts and designs, are held by BSG, except where copyright ownership is otherwise expressly stated. The trademark  Shape, logo, company name Description automatically generated     is also held by BSG.

7. THIRD PARTY LINKS:

This Microsite may contain links and references to third-party websites. The linked sites are not under the control of BSG, and BSG is not responsible for the content of any linked site, any link contained in a linked site or the privacy policy of any linked site. BSG provides these links only as a convenience, and the inclusion of a link or reference does not imply the endorsement of the linked site by BSG. BSG will not directly or indirectly be liable for any loss that may arise to you as a result of accessing the linked sites.

8. INDEMNITIES:

As a condition of use of this Microsite, you agree to indemnify and hold harmless BSG, its affiliates, directors, employees, from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of your use of this Microsite, including and without limitation,
  • your violation of rights of a third party including IPRs,
  • any infringement of the copyright or trademarks that are owned by BSG, or
  • any claims alleging facts that if true would constitute a breach of these Terms of Use.

9. WARRANTIES:

  • You expressly agree that use of this Microsite is at your sole risk. Neither BSG nor any of their respective employees, agents, third party content providers or licensors warrant that this Microsite will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of the Microsite, or as to the accuracy, reliability or content of any information provided through the Microsite.
  • The Microsite, including, without limitation, any downloadable material, is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose.

10. LIMITATION OF LIABILITY:

  • Under no circumstances shall BSG be liable for any loss, damage, liability or expense incurred or suffered, computer and/or device or technology failure or malfunction or for any form of direct or indirect, special, incidental, consequential, exemplary or punitive damages that is claimed to have resulted from the use of this Microsite or any alleged failure of performance, including, without limitation, any fault, error, omission, interruption, deletion, defect or delay, or any alleged computer virus, communication line failure, theft or destruction of property with respect thereto.
  • You agree that this limitation of liability applies whether such allegations are for breach of contract, tortious behaviour, negligence, or otherwise, regardless of the basis upon which liability is claimed and even if BSG has been advised of the possibility of such loss or damage.
  • Without limiting the generality of the forgoing, you also specifically acknowledge that while BSG seeks to regulate this Microsite to its best efforts, it is not liable for any actual or alleged defamatory, offensive, or illegal conduct of other users of the Microsite or any other third parties.

11. AVAILABILITY OF MICROSITE AT ALL TIMES:

While BSG endeavours to ensure that this Microsite is normally available 24 hours a day, BSG shall not be liable if for any reason it is unavailable at any time or for any period. Access to this Microsite may be suspended temporarily and without notice in the case of system failure, maintenance, upgrade or repair or for reasons beyond BSG's control.

12. SEVERABILITY:

Except as specified in Section 13 (Governing Law, Jurisdiction and Dispute Resolution), if any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable for this Terms of Use and shall not affect the validity and enforceability of any remaining provisions.

13. GOVERNING LAW, JURISDICTION & DISPUTE RESOLUTION:

These Terms of Use is governed by the laws of the Republic of India. You hereby consent and submit to the exclusive jurisdiction and venue of Courts in New Delhi, India in all disputes arising out of or relating to the use of this Microsite.

14. UPDATES:

  • To these Terms of Use: BSG reserves the right to change, without notice, these Terms of Use. The updated version will be indicated by an updated “revised” date and the updated version will be effective as soon as it is accessible. Your continued use of the Microsite will be subject to the Terms of Use in force at the time of the use.
  • To the Microsite: BSG may update, change or discontinue any aspect, service or feature of the Microsite at any time, including, but not limited to, content, hours of availability, and equipment needed for access or use. Such changed or updated Microsite shall also be governed by these Terms of Use.

15. GENERAL:

Nothing contained in this Terms of Use is in derogation of BSG’s right to comply with Governmental, Court and Law enforcement requests or requirements relating to use of this Microsite or information provided to or gathered by BSG with respect to such use.
